Architectural Review

Authority to Conduct Architectural Review

At the beginning of the Toro Park Estates subdivision, the original developers were declared as the Architectural Review Committee for Toro Park Estates.  This included unit 1 along with units 2 through 6 of the Toro Park Estates Subdivision, pursuant to Declarations of Restrictions recorded in the office of the Monterey County Recorder.  The Declarations provided that members of the original committee, or survivors of that committee, could designate a representative to discharge the responsibilities of the Architectural Review Committee. In the 1980's, the developers assigned responsibility of architectural review to the TPEHA which expired in 1991. In order to restore compliance and responsibility for perform architectural review, in March 2024, David A.S. Kelton and Mark Kelton exercised the authority to appoint the Board of Directors of the Toro Park Estates Home Association as the representative to discharge responsibilities of the Architectural Review Committee for units 1 - 6 of the Toro Park Estates Subdivision.

Items Requiring Architectural Review Include:    

 

1.  All additions to your house, including new roofs. â€‹

​​​​​​2.  Fences or walls in front of your house.

3.  All antennas, including TV dishes and CB radio.

4.  Decks and Spas.

5.  Painting your house in a new color which is not earth tone.  

6.  Alterations to the exterior appearance of the home, including changes in siding/ stucco, alteration of windows or doors, etc.

If you feel your addition or remodel is insignificant, most likely so will the Architectural Review Committee and it will be reviewed and expediated accordingly.  For larger projects, please submit a set of plans to the Architectural Review Committee and your earliest convenience and well before project permitting by the County and the start of construction.  Review will be completed within 30 days, per the CC&R's and you will be provided a written response.

Architectural Review Process Summary
 
  1. The homeowner should plan on completing the ARC review process prior to application to the Monterey County Department of Planning and Building Inspection. Early consultation with the ARC is highly encouraged. At an early stage of project planning, the ARC can help homeowners ensure that their plans conform to the CC&R’s and will not be subject to future conflicts.

  2. Submit an application, obtaining written approval of the application by the ARC, and subsequent adherence to the decision on the application.

  3. Once construction plans are prepared and materials chosen, the homeowner should submit a formal application to the ARC using the Architectural Review Application form found above.  The application should include:​

       - Site plan

       - Building elevations

       - A brief description of principal construction materials​

    4.  Because applications vary from something simple to more extensive, the ARC may be in contact following receipt of the
         application to schedule a meeting to go over the project.

    5.  As soon as possible, but within 30-days of submitting plans to the ARC, the application form will be completed by the ARC either                 approving the plans as complying with the CC&R’s, or finding that they do not.
